Terms & Conditions
1. Booking and Payment
– A non-refundable deposit of $50 (or 10% of the total project cost, whichever is greater) is required to secure your booking.
– The remaining balance must be paid prior to receiving the final photos/videos.
– Draft previews (if provided) will be watermarked and must not be posted online or shared publicly.
– Payment can be made via the agreed payment methods.
2. Cancellations and Rescheduling
– Cancellations made more than 7 days before the shoot may be rescheduled without penalty.
– Cancellations within 2 days will result in forfeiture of the deposit.
– Cancellations within 14 days of the shoot (for larger bookings such as weddings) may incur up to a $300 cancellation fee unless rescheduled.
– Rescheduling within 14 days of the shoot may incur a $100 rescheduling fee.
– In cases of illness, emergency, or unforeseen circumstances, the session can be rescheduled without penalty.
3. Session Details
– Sessions start at the scheduled time, even if the client arrives late. Late arrival does not extend the booking.
– Overtime beyond the scheduled session may be charged at $300 per hour.
– Clients are responsible for their own wardrobe, hair, and makeup unless otherwise agreed.
– Any location fees, travel, or accommodation costs are the responsibility of the client.
– Locations outside the agreed travel range may incur an additional fee.
4. Image Capture and Delivery
– The COMPANY is not obligated to deliver every captured photo or video.
– RAW/unedited files will not be provided.
– Edited images will be delivered via the agreed method (e.g., online gallery) within 2 weeks, unless otherwise specified.
– The number of final images/videos will match the chosen package.
– Extra images may be purchased at the additional fee outlined.
– It is the client’s responsibility to download and save images before the gallery expiry. Additional charges apply for re-sending expired galleries.
5. Image Use and Copyright
– The COMPANY retains full copyright of all images.
– Clients receive a personal license for non-commercial use.
– For commercial projects, usage rights will be agreed upon in writing.
– The CLIENT may not alter edits, apply filters, or remove branding/watermarks.
– Images may be used by the COMPANY for portfolio, social media, and promotional purposes unless otherwise agreed in writing.
– When sharing online, proper credit/tagging of Dony Joseph Photography is required.
6. Client Responsibilities
– The CLIENT is responsible for communicating expectations and requests prior to the shoot.
– The COMPANY is not liable for missed shots due to lateness, weather, venue restrictions, poor lighting, or uncooperative subjects.
– For full-day shoots, the CLIENT agrees to provide meals and hospitality for the photographer.
7. Photographer Safety
– The COMPANY reserves the right to terminate coverage if faced with unsafe, threatening, or inappropriate behavior.
8. Limit of Liability
– If the photographer cannot perform due to illness, injury, emergency, or events beyond control (e.g., natural disasters), the COMPANY will attempt to find a replacement.
– If no replacement is available, all payments made will be refunded.
– In the case of lost or damaged files, liability is limited to the amount paid or a prorated refund based on the footage lost.
